The twin 40-storey towers of Supertech’s Emerald Court project in Noida will be demolished in three months, the Supreme court ordered on Tuesday. The homebuyers will be refunded the entire amount along with an interest of 12% from the time of booking, the apex court said. It also stated that an amount of Rs 2 crore must be paid to Residents Welfare Association for the harassment it has suffered due to the construction of twin towers.
The demolition procedure of the Supertech’s twin 40 storey towers having 915 flats and shops is to be carried out within three months.
The bench said that this must be done under the supervision of Noida and an expert agency. Supertech Ltd will have to bear the entire cost of the exercise.
“The verdict of the Allahabad high court on April 11, 2014, which directed the demolition of twin towers, does not deserve any interference,” a bench of Justices D Y Chandrachud and M R Shah said.
The Allahabad High Court had declared the construction of two towers illegal and ordered their demolition.
Today’s SC verdict identified Allahabad High Court’s decision as correct. It stated that construction was done in collusion with Noida authority.
SC said that the rampant unauthorised construction in metropolitan areas in collusion with planning authorities must be dealt sternly.
Supertech Ltd to file review petition
Realty firm Supertech Ltd said that it will file a review petition against the Supreme Court order to demolish the company’s twin 40-storey towers in Noida.
Mohit Arora, Supertech’s managing director said the company will file a review petition in the Supreme Court.
