Judicial Win for Ankiti Bose: Restrictions Placed on Defamatory Content About Zilingo Former Chief

Delhi Court said that Zilingo, former CEO, Ankiti Bose, has a legal right to protect her reputation against unfair reporting.

A Delhi Court has passed an ex parte order in favor of Ankiti Bose, former Chief Executive Officer (CEO) of technology platform, Zilingo, entailing, the other party involved in the case to restrain from posting defamatory content against Bose. The other parties involved in the case are Zilingo, co-founder Dhruv Kapoor and former Chief Operating Officer (COO) Aadi Vaidya. According to the news publication, ‘Business Today’, the court has said, “A perusal of record shows that there exists prima facie case in favor of the plaintiff as the plaintiff has a legal right to protect her reputation against unfair reporting. The balance of convenience also lies in favor of the plaintiff, and more irreparable loss shall be caused to the plaintiff rather than the defendants.”

The court order clearly bars Kapoor and Vaidya from defamatory postings against the Zilingo’s former CEO. The judiciary has given the rationale behind its decree that Bose has a legal right to protect her reputation against unfair reporting.

The court added, “Furthermore, if the restraint order is not passed then the object of injunction shall be defeated by delay caused in notice of the application to the defendants,” the court added.

Earlier, Bose had filed a six page First Information Report (FIR) against her two former colleagues. She had accused the duo of sexual harassment and irregularities in day to day business of the firm. Prior to that, she was ousted from the company for allegedly failing to perform her duties. But she accused the duo of canteen culture in the office behind the company’s fallout. Shredding all the allegations, the duo have said that her filing the FIR is nothing but retaliatory action.

B2B fashion startup, Zilingo has seen deteriorating financial conditions since its launch in 2015. The company is now undergoing liquidation.
