The Noida, Greater Noida and Yamuna Authority will now come out with a plot scheme only when it has the possession of land on which the scheme is announced. Authorities have to ensure that there is no dispute on that piece of land from the side of the farmers. If there is any, it has to be settled first. An order has been issued by the government for this. Nidhi Srivastava, Special Secretary in the Government of Uttar Pradesh, has written a letter to the authorities where it has also been mentioned that the Allahabad High Court has taken a tough stand on this matter. Therefore, everything has to be implemented properly according to the order.
What is the matter? Recently, a petition has been filed in the Allahabad High Court on behalf of ATS Infrastructure Limited. In this, the builder had said that the Noida Authority sold the land to it in Sector 150 without acquiring it from the farmers. After this, due to non-availability of land on time, the builder could not develop the project within the stipulated time and the allotment of the plot was cancelled. The Allahabad High Court had questioned the Noida Authority on how the land was sold to the builder without land acquisition. After this, the court said that no property allocation scheme should be initiated until the parts of the land are properly bought.
A similar case is also related to Amrapali builder. About 4,000 square metres of similar land was sold to Amrapali builder which was not acquired from the farmers by the authority. Later, there was a long legal battle between the farmers and the authority over its acquisition. There was also a case related to the Yamuna Authority in which the Authority had taken out the plan of industrial plots in Sector 32 and 33 in 2013. In this, there were 55 plots which were not acquired. It was allotted for setting up industries. Yamuna Authority has not been able to buy this land even after 10 years. After selling the land without acquiring it, the farmers put many conditions in front of the authority. The authority refused to accept those conditions. Amidst all this, the allottees are getting restless. And such cases are in abundance. But now after this order of the government, these problems may not arise in future.
What would be the benefit? After the new order, now the authorities of Gautam Budh Nagar will release the scheme of residential and commercial plots only when they have physical possession of the land. With this, the allottees will not have to wander to take possession of their properties.
